Wristo operates this store and website, including all related information, content, features, tools, products and services, to provide you, the customer, with a carefully curated shopping experience (the “Services”). Wristo is powered by Shopify, which enables us to offer the Services to you.
The following terms and conditions, together with all policies referenced in them (these “Terms of Service” or “Terms”), describe your rights and responsibilities when using the Services.

When you place an order, you make an offer to purchase. Wristo reserves the right to accept or reject your order for any reason at its sole discretion. Your order is not accepted until Wristo confirms acceptance. We must have received and processed your payment before your order is accepted. Please check your order carefully before submitting it, as Wristo may be unable to accommodate cancellation requests after an order has been accepted. If we do not accept, change or cancel an order, we will attempt to notify you using the email address, billing address and/or phone number you provided when placing it.
Your purchases may only be returned or exchanged in accordance with our Refund Policy.
You represent and warrant that your purchases are for personal or household use and not for commercial resale or export.

SECTION 4 - PRICES AND BILLING
Prices, discounts and offers may change without prior notice. The price charged for a product or service is the price in effect when the order is placed and is stated in your order confirmation email. Unless expressly stated otherwise, listed prices exclude taxes, shipping, handling, customs charges or import duties.
Prices listed in our online stores may differ from prices offered in physical stores or online or other stores operated by third parties. We may occasionally offer promotions on the Services that affect pricing and are governed by separate terms and conditions. You represent and warrant that (i) the credit card information you provide is true, accurate and complete, (ii) you are duly authorised to use that credit card for the purchase, (iii) your credit card company will honour the charges you incur, and (iv) you will pay the charges you incur at the listed prices, including shipping and handling charges and any applicable taxes.

SECTION 5 - SHIPPING AND DELIVERY
We are not liable for shipping or delivery delays. All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by carriers, customs processing or events outside our control. Once we hand the products over to the carrier, ownership and the risk of loss pass to you.

Our Services, including but not limited to all trademarks, brand names, text, displays, images, graphics, product reviews, video and audio, and their design, selection and arrangement, are owned by Wristo, its affiliates or licensors and protected by US and foreign patent, copyright and other intellectual property laws.

Wristo's names, logos, product and service names, designs and slogans are trademarks of Wristo or its affiliates or licensors. You may not use them without Wristo's prior written permission. Shopify's name, logo, product and service names, designs and slogans are trademarks of Shopify. All other names, logos, product and service names, designs and slogans on the Services are trademarks of their respective owners.

SECTION 7 - OPTIONAL TOOLS
You may be given access to customer tools provided by third parties as part of the Services, which we do not monitor and over which we have no control or influence.
You acknowledge and agree that we provide access to such tools “as is” and “as available”, without warranties, representations or conditions of any kind and without endorsement. We have no liability whatsoever arising from or relating to your use of optional third-party tools.

Wristo is powered by Shopify, which enables us to offer the Services to you. However, all sales and purchases you make in our store take place directly with Wristo. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of sales between you and Wristo, including injury, damage or loss resulting from purchased products and services. You expressly release Shopify and its affiliates from all claims, damages and liabilities arising from or relating to your purchases and transactions with Wristo.

All personal information we collect through the Services is subject to our Privacy Policy, available here, and certain personal information may be subject to Shopify's Privacy Policy, which can be viewed here. By using the Services, you acknowledge that you have read these privacy policies.

In addition, you agree (a) not to upload or transmit viruses or other malicious code that will or may be used to affect the functionality or operation of the Services; (b) not to reproduce, duplicate, copy, extract, sell, resell or exploit any part of the Services; (c) not to collect or track the personal information of others; (d) not to misuse the Services for spam, phishing, pharming or pretexting; (e) not to use robots, spiders, scraping, data collection or extraction tools, automatic devices or processes, AI tools (such as agentic AI), or automated or manual means to access the Services; or (f) not to interfere with, circumvent or evade security or authorisation features, robot exclusion headers or other measures we use to restrict access to the Services. TO THE EXTENT PERMITTED BY LAW, IN NO EVENT WILL Wristo, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS OR LICENSORS, OR THOSE OF SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INJURY, LOSS, CLAIM OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS OR SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF THE SERVICES OR PRODUCTS PURCHASED THROUGH THEM, OR FOR ANY OTHER CLAIM RELATED IN ANY WAY TO YOUR USE OF THE SERVICES OR A PRODUCT, INCLUDING BUT NOT LIMITED TO ERRORS OR OMISSIONS IN CONTENT, OR LOSS OR DAMAGE OF ANY KIND INCURRED THROUGH USE OF THE SERVICES OR ANY CONTENT OR PRODUCT POSTED, TRANSMITTED OR OTHERWISE MADE AVAILABLE THROUGH THEM, EVEN IF ADVISED OF THE POSSIBILITY.

You agree to indemnify, defend and hold harmless Wristo, Shopify and our affiliates, partners, officers, directors, employees, agents, contractors, licensors and service providers from all losses, damages, liabilities or claims, including reasonable legal fees, payable to third parties as a result of or arising from (1) your breach of these Terms of Service or the documents they reference, (2) your violation of any law or a third party's rights, or (3) your access to and use of the Services.
We will notify you of any claim subject to indemnification, provided that failure to give prompt notice will not relieve you of your obligations unless you are materially prejudiced by it. We may control the defence and settlement of such a claim at your expense, including the choice of counsel, but will not settle a claim requiring non-monetary obligations from you without your consent, which may not be unreasonably withheld. You will cooperate in defending indemnified claims, including by providing relevant documents.

SECTION 19 - SEVERABILITY
